A operação adota os marcadores de superfície típicos de uma corretora legítima: estruturas de contas em níveis, acesso à negociação e um registro empresarial em uma jurisdição offshore reconhecida, o que lhe confere uma aparência de credibilidade institucional.
A fragilidade estrutural está na forma como a ACA Next trata o seu status regulatório. O operador está registrado como International Business Company (IBC) sob o International Financial Centre de Santa Lúcia, um status que confere existência jurídica, mas que não implica nenhuma supervisão regulatória financeira. O IFC não licencia nem regula atividades de negociação de forex; o registro de IBC não pode ser tratado como uma licença de operador (dealer) nem como autorização para negociar. Os usuários que depositam recursos não recebem nenhuma das proteções que uma corretora regulada seria legalmente obrigada a fornecer.
O ponto de ruptura para os usuários costuma se tornar evidente no momento do saque. Uma operação que funciona sobre uma infraestrutura não regulada não tem nenhuma obrigação externa de conformidade para devolver os fundos dos clientes quando solicitado.
